Greenbrier grand jury returns indictments (2024)

A Greenbrier County grand jury handed up more than 60 indictments during a two-day session this week.

Among those charged was Antonio Dewayne Smith, who is accused of causing causing fatal injuries to Ira Lindberg Harris during a Feb. 26 scuffle in a hallway outside a Lewisburg apartment. Smith, 34, of Wheeling was indicted on a charge of voluntary manslaughter for allegedly shoving Harris down a flight of stairs.

The 23-year-old Harris, an entertainer employed by both The Greenbrier and Greenbrier Valley Theatre, died in a Charleston hospital one day after suffering massive head injuries in the incident.

Indicted on a malicious assault charge was Justin Robert Pack, 29, of Frankford. He allegedly hit and beat Joshua Paul Quick in the parking lot of the Lewisburg Godfather Pizza/Little General gas station on Feb. 19.

An employee of the gas station, Quick suffered serious injuries in the attack which, Pack told investigators at the time, was prompted by Quick’s refusal to extinguish a cigarette.

According to a statement in the court file by Sheriff’s Cpl. G.R. Workman, Pack told him Quick was smoking a cigarette near one of the station’s fuel pumps, which frightened Pack.

A third indictment charged Dannie J. Midkiff, 62, of Alderson with two counts of wanton endangerment involving a firearm for an alleged April 23 incident in which the victims were among four people later found murdered in Nicholas County in late May.

Midkiff is accused of discharging a firearm at a motor vehicle occupied by Stephen Hendrix and a 4-year-old child identified in the court file only by the initials “K.H.”

Hendrix’s body, along with those of his children, 4-year-old Kaylee and 6-year-old Dakota, and girlfriend, Amber Masters, was found late last month tossed over a hillside near the Nicholas County home of James Roy Belknap, who is charged with the slayings.

There is no indication in the court file of a link between Midkiff and Belknap.
